Fundamentals of the Marketing Agreement
The requirements for marketing activities as well as copy deadlines must be observed by both parties. CWT will not always notify its contractual partners separately of upcoming deadlines. The supplier will, however, be notified in advance of any changes in a deadline. If a deadline is not met, CWT is entitled to exclude the supplier from the corresponding marketing medium. There will be no reimbursement of payment or of any potential costs incurred due to such exclusion. Nor will a refund be made if the supplier does not take advantage of agreed marketing activity. Agreed marketing activities cannot be changed during the year.
In addition, the supplier must name a contact person responsible on its behalf for all matters concerning the coordination, communication and delivery of the marketing agreement. CWT will coordinate all marketing activities exclusively with the agreed contact person.
Cancelation*
In the event a supplier cancels a previously agreed activity, CWT will do it’s best to work with the supplier to reallocate the funds to other activities. However, if there is a negative financial impact to CWT, CWT reserves the right to retain the monies without finding alternative activities to compensate. Cancelation within the following timelines will result in forfeit of monies due to financial implication posed to CWT:
- Events – less than 12 weeks
- Publications – less than 8 weeks
- E-newsletters – less than 6 weeks
- Advertising – less than 6 week
